¿Qué tipo de permiso necesita un extranjero para trabajar en Chile?
Para las producciones
internacionales que vienen a filmar a Chile, la normativa de Extranjería
contempla cuatro permisos de trabajo:
1.-Trabajar como turista
El Departamento de Extranjería y Migración del Ministerio del
Interior (DEM) autoriza, en algunos casos, a trabajar por un plazo máximo de 30
días, prorrogables mientras se mantenga vigente el permiso de turismo.
Esta autorización debe ser tramitada por el turista ante dicho
departamento, adjuntando el respectivo contrato de trabajo. También puede ser
gestionada por el empleador local, quien necesitará un documento notarial del
interesado autorizando la realización de este trámite.
2.-Trabajar como artista:
Los artistas que vienen a Chile para estadías laborales de 90
días o menos pueden obtener el permiso correspondiente ante el DEM o, fuera de
la Región Metropolitana, en la oficina de Extranjería de la Gobernación
Provincial.
Este permiso debe ser tramitado por el responsable del o los
artistas contratados.
3.-Acreditación para corresponsal extranjero
Este permiso de trabajo es muy utilizado por los profesionales
de prensa (para corresponsalías, reportajes, entrevistas y artículos), pero
también es apto para las producciones documentales.
Se pueden obtener dos acreditaciones distintas, ambas de
carácter gratuito:
1. Corresponsal extranjero residente.
2. Corresponsal extranjero en tránsito.

Ministerio Secretaría General de Gobierno, están todos los detalles del proceso
para obtener la acreditación.
4.- Contratación de
extranjeros
La empresa o institución que contrate a un trabajador
extranjero para que trabaje en el país debe tener domicilio legal en Chile y
personalidad jurídica (con un RUT que lo acredite).
El contrato de trabajo debe firmarse en Chile ante notario, por
el empleador y el trabajador (o quien lo represente), y debe cumplir con las
disposiciones laborales y previsionales pertinentes, más las que exige el DEM
para la obtención de visa sujeta a contrato de trabajo.
Una empresa extranjera sin domicilio legal en el país no puede
realizar contratos laborales en Chile a trabajadores chilenos. Sin embargo,
puede contratarlos de forma indirecta mediante la adquisición de servicios de
producción locales.
What type of permit is required
to work in Chile?
Work permit for foreigners
Immigration regulations provide the following four work permits for
international productions shooting in Chile:
1. Working as a tourist: The Department of Immigration and Migration
(DEM) of the Ministry of the Interior authorizes, in some cases, a maximum
working period of 30 days, renewable as long as there is a valid tourism permit.
The interested party must carry
out this procedure, and present employment contract to the aforementioned
department. The local employer, who will need a notarial deed granting him

2. Working as an artist: Artists who come to Chile for work stays of 90
days or less can obtain the corresponding permit at the DEM or, if work is undertaken

3. Accreditation for foreign correspondent: This work permit is widely used by press
professionals (reports, interviews and articles), but it is also suitable for
documentary productions.

4.-Hiring foreigner workers
A company or institution hiring
a foreign worker in the country must have legal domicile in Chile and have a
legal personality with a Tax File Number.
The employment contract must be
signed in Chile at the notary by the employer and the worker (or whoever
represents him). These must comply with the relevant labor and social security
provisions, in addition to those required by the DEM regarding a visa subject
to a contract.
A foreign company without legal
domicile in the country cannot produce work contracts in Chile for Chilean
workers. However, you can contract them indirectly by acquiring local
production services.
¿Cuáles son las regulaciones para
el ingreso temporal de mercancías?
La internación a Chile de bienes eximidos de impuestos es
posible mediante una admisión temporal o bien con el uso del carnet ATA.
La admisión temporal es la norma de carácter general y requiere
rellenar un formulario.
ATA es más simple pues considera tasas y costos prefijados, y es
más ágil pues no requiere el uso de un formulario sino la sola presentación del
carnet. De este modo, cuando se pueda utilizar, el carnet ATA será siempre la
mejor opción para el ingreso a Chile de bienes eximidos de impuestos.
Paso a paso de
internación de mercancías extranjeras a Chile:
• Desde el extranjero, se debe ingresar la carga a la aduana de
su país y realizar el trámite de salida temporal del producto.
• En Chile, la gestión de entrada de la mercancía se puede hacer
en forma particular directamente en aduana o con la ayuda de un agente de
aduana. También es posible solicitar ayuda a una agencia asesora de comercio
exterior.
El trámite consiste en reunir toda la documentación necesaria
para la internación de los productos, guía aérea y factura con el detalle de
los artículos incluidos, y revisión de la carga en la aduana.
Internación de equipos profesionales
Los artículos que se pueden ingresar a Chile sin pagar los
derechos de aduana ni impuestos son el equipaje de viajero y los artículos sin
carácter comercial adquiridos en tiendas libres de impuestos por un valor de
hasta US$500.
El equipaje de viajero:
• No debe tener carácter comercial, es decir, incluir cantidades
que excedan al uso y necesidades comunes del viajero.
• Debe ingresar conjuntamente con el viajero o dentro de los 120
días anteriores o posteriores a su arribo al país. En estos últimos casos,
además, las mercancías deberán venir consignadas a su nombre en el manifiesto
y/o documento de transporte correspondiente.
What are the regulations for
goods temporary import?
In Chile, tax-free import of
goods is possible with a temporary admission or with the ATA Carnet. Temporary
admission is the general rule and requires filling out a form.
ATA is simpler because it
considers pre-fixed rates and costs, and it is faster because
it doesn’t require a form, but
rather just the presentation of this card. Thus, if available, the ATA Carnet
will always be the best option for tax-free import of goods.
Step by step imports in Chile
• From abroad, you must take the
items to your local customs and carry out the procedure for temporary exit of
goods.
• In Chile, you can manage the
import of goods by yourself or with the aid of a customs agent.
It is also possible to request assistance
from an external trade advisory agency.
The procedure consists of
gathering all the necessary documentation for the import of goods. These
include the air waybill and the respective invoice, which outlines details for
the items included, in addition to customs controls of the cargo.
Import of professional equipment
Items that can be brought into
Chile without paying custom duties or taxis are traveler’s luggage and
non-commercial items purchased in duty-free stores worth up to US$ 500.
Traveler’s luggage:
• It should not have a
commercial nature, that is, it cannot include quantities exceeding a traveler’s
common needs.
• It must enter together with
the traveler or within 120 days before or after his or her arrival in the
country. In these latter cases, the items must also be labeled with your name
on the corresponding manifest and/or transportation document.
For the temporary import of
items besides the traveler’s luggage, foreigners or Chileans living abroad can
also import, for up to 90 days, goods that are not included in the concept of
traveler’s luggage. However, these are to be used in the country and later be
returned abroad.
This temporary admission is
formalized by signing the Declaration of Temporary Admission of Tourist
Belongings, which is provided by the National Customs Service.
It is important to consider that
the import of certain items requires visas or special permits. According to
current legislation, they might be submitted to control by a State agency
before import and customs procedures.

¿Cómo puedo contratar profesionales
en Chile y cuáles son las regulaciones para esta contratación?
Para el contrato laboral de profesionales chilenos deben
considerarse los siguientes aspectos:
En el área laboral del sector audiovisual rige la Ley 19.889 de
Trabajadores de Artes y Espectáculos, que establece el uso del contrato y todo
lo que deriva de ello. Junto con esta normativa también opera la Ley Tributaria
20.219, que señala que los técnicos y profesionales del Cine y Audiovisual,
aparte de realizar contratos, deben emitir una boleta (documento tributario de
prestación de servicios) que compromete el pago del 10.75% del sueldo bruto.
De acuerdo a la normativa chilena, el empleador debe llevar una
contabilidad en la que haga los descuentos (también llamados imposiciones)
• Administración de Fondos de Pensiones (AFP) Dinero del
trabajador. Varía según la AFP.
• Salud
Dinero del trabajador, corresponde al 7%.
• Fondo de cesantía A cargo del empleador, corresponde al 3%. •
Seguro contra accidentes A cargo del empleador, corresponde al 0,95%. •
Retención del 10% • Vacaciones proporcionales
Solo en proyectos sobre los 30 días. Es 4,2% aproximadamente. •
Descuento cuota sindical Afiliados a Sindicato
Nacional Interempresa de Profesionales y Técnicos del
Cine y Audiovisual (Sinteci). Es el 1%.
En general, cuando se realizan los proyectos se habla de sueldos
líquidos (valor neto) y es importante acostumbrarse a hablar de sueldos brutos
para conocer los gastos que incluye la remuneración total.
How can I contract Chileans professionals and what are the working
regulations in this area?
In the audiovisual sector, Law
19,889 of Arts and Entertainment Workers establishes the use of contracts.
Along with this regulation, there is also Tax Law 20,219, which states that
film and audiovisual technicians and professionals, besides having contracts,
must issue a ballot (tax document for the provision of services) that commits
the payment of 10% of gross remuneration.
According to Chilean
regulations, the employer must keep accounts and carry out the corresponding
discounts (also called taxation):

according to each AFP.
• Health

corresponds to 7%.

In general, when projects are
carried out, salaries are referred to in their net value, so it is important to
get used to gross salaries in order to be aware of the expenses included in
total remuneration.
